As established by Ministerial Decree No. 370 of 03/09/1998: this is the legally mandatory guarantee covering obligations arising from waste shipments, required for cross-border waste transport. It is issued by the company in favor of the Ministry of the Environment to protect the Public Administration from bearing any related costs. Therefore, it safeguards the community—represented by the Ministry of the Environment—against risks associated with transboundary waste transport, regarding potential expenses incurred by the Public Administration for transport (including cases under Arts. 25 and 26 of EEC Regulation No. 259/93), as well as for recovery or disposal, and for direct and indirect costs for the remediation of polluted sites linked to said operations.
